Water Damage From Condo Above, Florida Steps to Take Now

With water damage from condo above, Florida law and your HO-6 policy decide who pays. For water damage from the condo above, Florida rules start the same way: get the water stopped at the source, protect your unit, photograph everything, and notify the association or property manager, your neighbor and your own insurer the same day.

  1. Stop the source. Knock on the door above. If no one is home, call the property manager or building maintenance. Many buildings can shut off water to a single unit or a whole stack.
  2. Protect your unit. Buckets and towels under drips, furniture and electronics moved away. Stay out from under a sagging ceiling.
  3. Cut power to wet rooms from a dry spot if water is near lights, outlets or the panel.
  4. Document it. Photos and video of ceilings, walls, floors and damaged belongings, with the date and time.
  5. Report it. Tell the association or manager in writing, tell your neighbor, and notify your own HO-6 insurer.
  6. Call (239) 837-2323. Our licensed local crew can map moisture in your unit and, with permission, the units around it.

Water damage from the condo above is the most common condo call we get. Report fast even if the damage looks small. Under Florida law, an association doesn’t have to pay for repairs as a common expense when an owner knew, or should have known, about a loss and didn’t report it until after the claim was settled or denied for late filing (F.S. 718.111).

Condo leak questions answered in short

What unit owners and boards ask first about condo water damage Fort Myers FL.

Who pays when water comes from the condo above?

In Florida the association usually covers the building as originally built, and each owner covers finishes, cabinets, appliances and belongings in their unit under Florida Statute 718.111(11). Negligence can change who pays.

Who should I call first?

The building manager or association, so they can confirm the source is shut off. Then your own insurer, then a restoration crew to start drying.

Can drying start before the association approves repairs?

Yes. Drying is mitigation, meant to stop more damage, and should start right away. Opening shared walls or common areas usually needs the association’s approval.

Who pays after a condo leak in Florida?

It depends on what was damaged, what caused the leak and what your declaration says. Florida Statute 718.111(11) splits coverage between the association’s master policy and each owner’s own policy.

Who pays for condo water damage in Florida when a neighbor caused it

Under 718.111(11)(j), a unit owner is responsible for repair costs not paid by insurance when the damage was caused by their intentional conduct, negligence, or failure to follow the declaration or association rules. That includes damage caused by family members, tenants and guests, and damage to other owners’ personal property. If insurance later reimburses the association for repairs that owner paid for, the association pays the owner back.

When it is a common expense

Other damage covered by insurance is a common expense of the condominium under the same section.

Declarations vary, and some were written before later changes to the law. For a disputed loss, have a Florida-licensed attorney read your documents. This page is general information, not legal advice.

HO-6 water damage coverage: what your policy should pay

Your HO-6 policy pays for the parts of the unit the master policy leaves out: finishes, fixtures, appliances, your belongings and any loss assessment from the association.

  • Loss assessment coverage. Under Florida Statute 627.714, a unit owner policy must include at least $2,000 of property loss assessment coverage, with a deductible of no more than $250 per direct loss.
  • Is $2,000 enough? Master policy deductibles can be large, and associations can assess owners for them. Ask your agent what your master policy deductible is and whether you need a higher loss assessment limit.
  • Interior finishes and fixtures. Flooring, cabinets, countertops, water heaters and appliances, as listed above.
  • Contents and loss of use. Your belongings, and hotel or rent costs if the unit can’t be lived in during repairs.

Why condo leaks spread so far

Condos stack the wettest parts of every unit on top of each other. A leak in one kitchen or AC closet usually finds the same room one floor down.

  • Stacked kitchens, baths, AC closets and water heaters. Water damage from the condo above follows the plumbing chase straight down.
  • Slab-to-slab travel. Water can run across a concrete floor under tile and surface in a different room, or leak through a penetration into the unit below.
  • Shared walls. Moisture wicks sideways into the drywall of the unit next door.
  • Owners who are away. Many condos in Lee County are seasonal homes. A leak in an empty unit can run for weeks.

Air handlers and water heaters are the two sources we hear about most. See AC leak water damage and burst pipe and water heater leaks. Some associations set rules on water heater age or require drain pans. Check yours.

How a multi-unit drying job works

Condo water damage in Fort Myers usually means one source, several units and several insurers. A good crew maps every affected unit and keeps separate records for each one.

  1. Find the source unit and make sure the leak is stopped and repaired.
  2. Map moisture in every affected unit, including the one next door and the one below the one below. Water keeps going until something stops it.
  3. Keep separate photos, readings and estimates per unit so each insurer sees only its own share.
  4. Get each owner’s permission before work starts in their unit. The association authorizes work on common elements.
  5. Coordinate access through the manager, especially when owners are out of state.
  6. Share the drying logs and final readings with each owner and the association.

No one can sign your insurance benefits over to a contractor on a policy issued on or after January 1, 2023 (F.S. 627.7152). You and each other owner stay in charge of your own claims.

These jobs often span two or three units, so moisture mapping needs access to each one.

For boards and property managers

A short condo water damage plan written before the next leak saves days of confusion and a lot of money.

  • Keep a map of unit and riser shutoff valves, and make sure staff know where they are
  • Keep a 24/7 contact list for owners, including out-of-state owners and their key holders
  • Have a water mitigation vendor lined up before hurricane season
  • Review the declaration and rules on water heaters, supply lines and leak sensors
  • Report losses to the master policy carrier promptly, and ask owners to report to theirs
  • Keep the drying records with the claim file

Seasonal condo owners

If you leave for the summer, leave the AC on, turn the water off if your building allows it, and give the manager a working phone number.

The Florida Department of Health warns against shutting off air conditioning in Florida buildings, because a closed, hot, humid unit is where mold starts. Ask a neighbor or a home watch service to check the AC closet and under sinks every week or two.

Condo water damage across Fort Myers

From downtown high-rises to beach mid-rises and Gateway villas, the rules above apply to every Florida condominium. The building type changes how water moves.

  • Downtown River District (33901): high-rise towers along the Caloosahatchee, where one leak can reach several floors.
  • Fort Myers Beach (33931): mid-rise and low-rise buildings on Estero Island, many rebuilt or repaired after Hurricane Ian.
  • Gateway (33913): attached villas and townhomes with shared walls.
  • Whiskey Creek, Cypress Lake and McGregor (33919): older low-rise condo communities with original plumbing in some units.

What does condo water damage cleanup cost?

Cost depends on how many units the water reached, the water category and how many days drying equipment runs.

Nationally, water damage restoration averages $3,868, with most jobs between $1,383 and $6,369 (Angi, 2026). A clean supply-line leak caught the same day in one unit sits at the low end. A water heater that ran overnight through two floors does not.

In a condo the bill is usually split. The association’s master policy pays for the building as originally installed, each owner’s HO-6 policy pays for finishes and belongings, and the owner whose unit caused the leak may owe what insurance does not. Ask for one written scope per unit so each insurer sees only its own line items.

How to prevent the next condo leak

Most condo water damage Fort Myers buildings see starts with the same few parts.

  • Close your unit’s water valve when you leave for more than a few days.
  • Replace washing machine hoses on the schedule the maker suggests, often about every 5 years.
  • Check the water heater’s age. Tank heaters last about 10 to 15 years (U.S. Department of Energy).
  • Have the AC drain line flushed at every service.
  • Fit leak sensors under sinks, the water heater and the air handler.

Condo water damage questions

Short, straight answers about condo water damage in Fort Myers and who pays.

Call (239) 837-2323, day or night.

Stop the water at the source or call the manager to shut it off, protect your unit, photograph everything, and notify the association, your neighbor and your own insurer in writing the same day. Then get the moisture mapped before anything is covered up.

Water heaters are excluded from the association’s master policy by Florida Statute 718.111(11)(f), so the owner’s HO-6 policy covers the heater and that owner’s finishes. If the owner was negligent or broke association rules, that owner is responsible for repair costs insurance doesn’t pay, including damage to other units.

The master policy covers condominium property as originally installed, minus the items the statute excludes, such as wall coverings, cabinets and fixtures. How your declaration treats drywall and later improvements decides the rest, so check it or ask the manager.

Your declaration or your mortgage lender may require one. Even when it isn’t required, it is the policy that pays for your finishes, fixtures, belongings and any loss assessment.

If the damage came from your negligence or a rules violation, you can be responsible for costs insurance doesn’t cover. Otherwise, covered damage is generally a common expense. Florida law also requires your HO-6 policy to include at least $2,000 of loss assessment coverage.

Photos, a moisture map of every affected unit, the plumber’s or HVAC contractor’s written finding and the failed part. Keep all of it with your claim.

Yes, report it to your own insurer anyway. Your insurer can pay your covered losses and then recover the money from whoever was responsible, and late notice can hurt your claim.

Most single-unit leaks dry in 3 to 5 days once equipment is set. When water reached several units, each one is metered and dried, and association approvals can add time.
